Terms of Service

1. Acceptance of Terms

By accessing or using ThirdWatch (“the Service”), operated by ThirdWatch (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

We may modify these terms at any time. Changes take effect upon publication on this page. Continued use of the Service after changes constitutes acceptance.

2. Description of Service

ThirdWatch is a cloud-based API monitoring platform that provides:

  • HTTP/HTTPS endpoint health checks at configurable intervals
  • Multi-channel alerting (Discord, Slack, Microsoft Teams, Webhooks)
  • API scenario testing with variable extraction and assertions
  • Incident management and tracking
  • Automatic authentication for protected endpoints (OAuth2, API keys, JWT)
  • Swagger/OpenAPI import for bulk monitor creation
  • Team collaboration with role-based access control

3. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 18 years old to create an account. Each person may maintain only one account.

4. Subscription Plans & Billing

4.1 Plans

ThirdWatch offers the following plans:

  • Starter (€11.99/month) — 20 monitors, 5-minute checks, 3 team members, 3 alert channels, monitor groups, 30-day history, 14-day free trial
  • Pro (€25/month) — 50 monitors, 2-minute checks, 10 team members, unlimited alert channels, 20 API scenarios, 90-day history
  • Enterprise (€99/month) — 200 monitors, 1-minute checks, unlimited team members, 100 API scenarios, VPN routing for internal APIs, 1-year history

4.2 Free Trial

New accounts receive a 14-day free trial of the Starter plan. No credit card is required to start the trial. At the end of the trial period, you must select a paid plan to continue using the Service. If you do not subscribe, your account will remain active but monitoring will be paused.

4.3 Billing

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor (subject to Stripe's Services Agreement). All prices are in Euros (EUR) and exclude applicable taxes. You must maintain a valid payment method on file.

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.

4.5 Cancellation

You may cancel your subscription at any time from your account settings or the Stripe customer portal. Upon cancellation:

  • Your plan remains active until the end of the current billing period
  • You will not be charged for the next billing period
  • No prorated refunds are issued for the remaining time in the current period

4.6 Refund Policy

Refund requests made within 14 calendar days of a payment may be considered on a case-by-case basis. After 14 days, all fees are non-refundable. To request a refund, contact us at support@thirdwatch.app.

4.7 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the next billing period. If your current usage exceeds the limits of the new plan, you may be required to reduce usage before downgrading.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Monitor endpoints you do not own or have authorization to test
  • Use the Service to conduct denial-of-service attacks or excessive load testing
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Resell, redistribute, or sublicense the Service without written permission
  • Use the Service to transmit malicious code or interfere with its operation
  • Violate any applicable local, national, or international law

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

6. Data Ownership & Retention

You retain ownership of all data you submit to the Service (URLs, configurations, authentication credentials). We use your data solely to provide the Service.

Monitoring data (health check results, response times, incident history) is displayed according to your plan's retention period (30, 90, or 365 days). Data older than your retention period is not shown in the dashboard. Automated purge of expired monitoring data is planned for a future release.

Upon account deletion, your account and all associated data (organization, monitors, incidents, alerts, team memberships) are permanently deleted immediately via cascade deletion. If you are the last member of an organization, the organization and all its data are deleted with your account.

We may use anonymized, aggregated data for service improvements, analytics, and benchmarking. Such data cannot be used to identify you or your organization.

7. Security

We implement industry-standard security measures to protect your data, including:

  • Encryption in transit (TLS) and at rest (AES-256)
  • Authentication credentials encrypted with AES-GCM before storage
  • Role-based access control within organizations
  • Rate limiting and brute-force protection
  • Regular security updates and vulnerability scanning

While we take reasonable precautions, no system is 100% secure. You acknowledge the inherent risks of transmitting data online.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make reasonable efforts to notify users of planned maintenance in advance. We are not liable for any downtime or service interruptions.

9. Intellectual Property

ThirdWatch, its name, logo, and all related marks are our intellectual property. The Service, including its design, code, and documentation, is protected by copyright and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the subscription period.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied
  • We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim

This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

11. Indemnification

You agree to indemnify and hold harmless ThirdWatch and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

12. Account Termination

You may delete your account at any time from your profile settings. We may terminate or suspend your account at our discretion if you violate these terms, without prior notice and without refund.

Upon termination, your right to use the Service ceases immediately. Sections 6, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

These terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France, unless otherwise required by applicable consumer protection laws.
